SALES/FUNDRAISERS USING A STUDENT-ATHLETE

Last year the NCAA passed a new rule stating that schools are no longer allowed to sell items that include an individual student-athlete’s name, likeness, or picture (e.g., name on jersey, name or likeness on bobblehead doll or pin), other than informational items (e.g., media guide, schedule cards).  It remains ok to sell commercial items with names, likenesses, or pictures of multiple student-athletes (e.g., team poster).  (Bylaw 12.5.1.1(h)).  

Moreover, fundraising activities (e.g., raffles, silent auctions) involving the name, likeness, or picture of a student-athlete are treated in the same manner.  For example, at a fundraising event, it is not permissible to raffle a jersey with the name of a student-athlete affixed to it, even if other student-athletes sign the jersey.  However, if the jersey does not have the name of an individual student-athlete on it and it is signed by multiple student-athletes, it is permissible for the jersey to be raffled.

Finally, note that it remains permissible to give away items with an individual student-athlete’s name, likeness, or picture (e.g., Kyle Okposo bobblehead doll given to the first 2,000 fans); the rules only prohibit us from selling such items or using them in fundraising activities.
