TCF Bank Gopher For A Day Contest Official Rules
The “Gopher for a Day Contest” is sponsored by TCF National Bank (“Sponsor”). This contest is governed by these official rules (“Official Rules”). By participating in the contest, each entrant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the contest, as determined by Sponsor and its agents, are final in all respects. The contest is subject to all federal, state and local laws and regulations and is void where prohibited by law.
ELIGIBILITY
CONTEST OPEN TO THOSE LEGALLY RESIDING IN THE 50 UNITED STATES AND D.C. WHO ARE 18 YEARS OF AGE OR OLDER AT THE TIME OF ENTRY Participants must have Internet access and a valid e-mail account prior to the beginning of the Contest Period. Sponsor has the right to verify the eligibility of each entrant. Employees (and household family members of such employees) of Sponsor, the University of Minnesota, Facebook and each of their respective parents, affiliates, subsidiaries, and advertising, contest and fulfillment agencies, and their affiliates (All “Released Parties”) are not eligible. Void where prohibited or otherwise restricted by law. All federal, state and local laws and regulations apply.
CONTEST PERIOD
The Contest begins on July 8, 2019 at 8:00 a.m. CST and ends on August 4, 2019 at 11:59 p.m. CST. (“Contest Period”). All entries (submissions) must be received during that Contest Period. Sponsor reserves the right to extend or shorten the contest at their sole discretion.
HOW TO ENTER
You can enter the Contest through the Official Contest Landing Page: www.gophersports.com/GopherForADay. To enter, you fill out the necessary registration information.
LIMIT: One (1) entry per person/e-mail address. EEach person may enter using only one (1) e-mail address, and such email addresses account may only be used by one (1) person, regardless of whether the e-mail address is shared by two (2) or more people. Any participant who uses more than one (1) e-mail address to enter the Contest may be disqualified and any prize won may be forfeited at the Sponsor’s sole discretion. In case of a dispute as to the identity of any participant, entry will be declared made by the authorized account holder of the e-mail address used at the time of participation. “Authorized Account Holder” is defined as the natural person assigned an e-mail address by an Internet access provider, service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Proof of submitting or mailing an entry does not constitute proof of delivery/receipt. Sponsor is not responsible for lost, late, stolen, misdirected, incomplete, illegible or postage due entries. All entries become the exclusive property of the Sponsor and may not be acknowledged or returned. Any personal information provided by entrant at the time of entry will only be used in connection with this Contest and not for any other purpose. By entering, participants agree to be bound by these full Official Rules and the decisions of the judges, which will be final, binding and conclusive on all matters.
WINNER SELECTION
After the contest end date, all eligible entriesreceived during the Submission Period will be gathered into a database at the end of the Submission Period. Four (4) participants will be randomly chosen by Gopher Athletics. Each participating entry will represent one (1) minor, between 6 and 12 years of age, receiving the noted prizing.
The winners will be chosen on or about August 5, 2019 on or about noon CST. Announcement and instructions for prize will be sent via e-mail. Each entrant is responsible for monitoring his/her e-mailfor prize notification and receipt or other communications related to this contest. If a potential prize winner cannot be reached by Administrator (or Sponsor) within three (3) days, using e-mail, or if the prize is returned as undeliverable, that potential prize winner shall forfeit the prize and an alternative winner may be selected.
All potential winning ENTRIES are subject to verification by Sponsors, whose decisions are final AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. An entrant is not a winner of any prize, even if the CONTEST so indicates, unless and until entrant’s eligibility and the potential Winning ENTRY has been verified and entrant has been notified that verification is complete. ENTRANTS MAY BE REQUIRED TO COMPLETE AN AFFIDAVIT OF ELIGIBILITY, RELEASE AND PUBLICITY RELEASE in order to be declared a winner.
PRIZES:
Four – Minnesota Golden Gopher Football Experience on one (1) to-be-determined date during the 2019 Gopher Football Fall pre-season, whichfrom August 3, 2019 to August 27, 2019, practice schedule at University of Minnesota Athletes Village in Minneapolis, Minnesota. Each winner will receive the opportunity to have an associated minor, between 6 and 12 years of age, visit Gopher Football pre-season practice for the day. Each prize includes tour of Gopher Football Facility at University of Minnesota Athletes Village, ability to watch football practice, meal at University of Minnesota Athletes Village dining hall, photos in front of the TCF Bank – Gopher Football press backdrop and four (4) game tickets to the Minnesota Gopher vs. South Dakota State Football Game on August 29, 2019 at 8:00pm (subject to availability and restrictions). Winners will be required to attend with the child. Should potential winner be unwilling or unable to accept the prize for any reason, prize will be forfeited in its entirety and an alternate potential winner will be randomly selected, if feasible. No substitutions or cash equivalent of prize or any portion of prize is permitted, except at the sole discretion of the Sponsor. Any costs/expenses not expressly stated herein, including, but not limited to, travel, lodging, transportation to and from the event, parking, food and beverages, gratuities, merchandise, or services not specifically stated above are the sole responsibility of winner and his/her guests. Sponsor is not responsible for weather conditions, event cancellations, or any delays or other cancellations due to circumstances beyond Sponsor’s control. APPROXIMATE RETAIL VALUE (“ARV”) OF PRIZE: ($500). Total ARV of all prizes: $2,000.
Terms and conditions may apply. If a winner is unable to attend, prize will be forfeited and an alternative winner may be selected from among all eligible remaining entries, if feasible in Sponsor’s sole discretion. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE IS SOLELY THE RESPONSIBILITY OF THE WINNER. No transfer or assignment of prizes is permitted. Sponsor reserves the right to substitute prizes of equal or greater value.
Odds of winning depend on the number of eligible entries received. All prizes will be awarded if the number of eligible entries received is equal to or greater than the number of prizes available. Limit: One (1) prize per person.
No more than the stated number of prizes will be awarded.
ADDITIONAL LIMITATIONS
Prize is non-transferable. No substitution or cash equivalent of prizes is permitted. Released Parties, Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives are not responsible for any typographical or other errors in the offer or administration of the Contest, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any winner, or the distribution of any prize. Any attempt to damage the content or operation of this Contest is unlawful and subject to possible legal action by Sponsor. Any attempts by an individual to access the Web site or Contest technology via a bot script robotic program, script, macro, brute-force attack, or other automated means will result in that individual and/or e-mail address becoming ineligible and such entries disqualified. Sponsor further reserves the right to disqualify any individual who tampers with the entry process, attempts to defraud the Contest in any other way, or acts in an unsportsmanlike manner. Sponsor may prohibit a participant from entering the Contest or accepting a prize if it determines that said participant is attempting to undermine or has undermined the legitimate operation of the Contest by cheating, hacking, deception or other unfair practices or intending to abuse, threaten or harass other participants or acting in an unsportsmanlike manner. Sponsor reserves the right to terminate, suspend or amend the Contest, without notice, and for any reason, including, without limitation, if Sponsor determines that the Contest cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Contest. In the event any tampering or unauthorized intervention may have occurred, Sponsor reserves the right to void suspect entries at issue. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise. Sponsor is not responsible for printing or typographical errors in any Contest-related materials.
INDEMNIFICATION AND LIMITATION OF LIABILITY
BY ENTERING THE CONTEST, EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS RELEASED PARTIES, SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES, ADMINISTRATOR, ADVERTISING AND CONTESTAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THE CONTEST AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. RELEASED PARTIES, SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE. SPONSOR AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, ADVERTISING AND CONTESTAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE CONTEST.
PUBLICITY
DISPUTES: Entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Contest or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Minnesota or the appropriate Minnesota State Court located in Hennepin County, Minnesota; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Minnesota without giving effect to any choice of law or conflict of law rules (whether of the State of Minnesota or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Minnesota.
