DOCUMENT RETENTION POLICY

The University of Minnesota Athletics Department requires that documents concerning both student-athletes and prospects be kept in a student file, and that such student file be kept on hand for a minimum of six years.

The rationale in having such an institutional policy lies in NCAA Bylaw 32.6.3. This bylaw enacts a statute of limitations, providing specific exemptions to the clock for allegations involving current student athletes, allegations in a case in which a pattern of willful violations has occurred, or allegations that involve flagrant disregard for NCAA Bylaws.

The NCAA has adopted a broad interpretation of the “flagrant disregard” standard, allowing them to reach beyond the statute of limitations for inquiries. Keeping documentation longer prevents possible pitfalls in these situations.
